總統馬英九4月表示，菲律賓律師指太平島不是島嶼是岩礁，與事實完全不一致，他邀菲律賓政府派代表或律師，也歡迎荷蘭海牙常設仲裁庭仲裁員訪問太平島。
外交部相關官員受訪表示，馬總統表態後，分別向荷蘭海牙常設仲裁庭仲裁員，及透過駐菲律賓台北經濟文化辦事處向菲方提出登島邀請。
菲方當時私下就口頭表示不接受邀請登島，隨後馬尼拉經濟文化辦事處近期再回函拒絕，至於仲裁庭則是沒回應。
不過，外交部將持續邀5名仲裁員實地考察太平島，以避免仲裁庭對這項牽涉廣泛、備受關注仲裁案做出聽信菲方扭曲事實、曲解法律一面之詞，卻乏實證支持錯誤判斷。
外交部表示，如果仲裁庭仍決定不回應善意邀請，則不應對太平島法律地位做出裁決。如果仲裁庭最終判斷有任何損及中華民國南海主權及海域權利，對中華民國不具法律拘束力，政府既不承認也不接受。1050513
